Governing the use of the Jobbit application for iOS, including its AI tools, freelancer marketplace, and AI agent services, as distributed through the Apple App Store.
1. Introduction and Acceptance
1.1 Governing Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Jobbit application for iOS (the “App”), including all services, features, and content made available through it (together, the “Platform”), operated by Josephine Willis, a sole trader trading as Jobbit (“Jobbit,” “we,” “us,” or “our”). These Terms apply only to the App as distributed through the Apple App Store. Access to Jobbit services through any website or other application is governed by the separate terms published for that service.
1.2 Acceptance of Agreement
By creating an account, accessing any part of the Platform, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, each of which is incorporated herein by reference (collectively, the “Agreement”). If you do not agree to any part of this Agreement, you must not access or use the Platform.
1.3 Updates to Terms
We reserve the right to update these Terms at any time. Material changes will be notified to you by email or by prominent notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after such notice constitutes acceptance of the updated Terms.
2. Platform Identity and Operator Status
2.1 Operator Information
The App is published and operated by Josephine Willis, an individual established in England and trading as a sole trader under the name Jobbit. Our business address is Flat 5, 26 Sussex Street, Brighton, BN2 9QW, United Kingdom. You can contact us at ‘business@jobbit.uk’.
2.2 Jobbit’s Role as Intermediary
2.2.1 Jobbit operates exclusively as a technology platform. In respect of the freelancer marketplace and any services arranged through the AI Agent:
- Jobbit acts solely as an intermediary facilitating connections between Users and independent service providers (“Freelancers”). Any contract for physical services is formed directly between the User and the Freelancer. Jobbit is not a party to that contract.
- Jobbit does not employ, supervise, direct, or control Freelancers. Jobbit does not guarantee the quality, safety, legality, or availability of any services offered by Freelancers.
- Where the AI Agent arranges services on a User’s behalf, the resulting contractual relationship remains between the User and the relevant Freelancer(s). The AI Agent acts as the User’s digital delegate, not as an independent contracting party.

4. Eligibility and Account Registration
4.1 Age Requirements
4.1.1 You must be at least 18 years of age to create an account, use the Freelancer marketplace, use the AI Agent, or make any financial transactions on the Platform.
4.1.2 Users aged 16 or 17 may use the AI creative tools (excluding Face Swap, Motion Sync, Avatar, and Photoshoots) with verifiable parental or guardian consent. No person under the age of 16 may use any part of the Platform.
4.1.3 All tools that process Biometric Data are restricted to Users aged 18 and over, without exception.
4.1.4 Jobbit reserves the right to request proof of age at any time and to immediately suspend or terminate any account where we reasonably believe the User does not meet the applicable age requirement.
4.2 Account Obligations
4.2.1 By registering for an account, you agree that:
- all information you provide is accurate, current, and complete, and you will update it promptly if it changes;
- you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account;
- you will immediately notify us at ‘business@jobbit.uk’ if you become aware of any unauthorised use of your account or any other breach of security; and
- you may not create more than one account, share your account credentials, or transfer your account to any other person without our prior written consent.
5. AI Tools: Outputs, Ownership, and Disclaimers
5.1 Nature of AI Outputs
5.1.1 All AI Outputs are generated by automated systems and are provided strictly on an “as-is” and “as-available” basis. Jobbit makes no representations and gives no warranties, whether express or implied, that any AI Output will be:
- accurate, complete, reliable, or free from errors, hallucinations, or artefacts;
- original, unique, or free from similarity to existing works or real persons;
- fit for any particular purpose, including commercial, professional, or legal use; or
- free from infringement of any third-party intellectual property or other rights.
5.1.2 You use AI Outputs entirely at your own risk. Jobbit shall not be liable for any loss, damage, claim, or liability arising from your use of or reliance upon any AI Output.
5.2 Intellectual Property Ownership
5.2.1 Ownership of AI Outputs is determined as follows:
- User-Generated Inputs: You retain all intellectual property rights in the original content you upload to the Platform (your prompts, photographs, videos, audio, and text).
- AI Outputs: Under section 9(3) of the Copyright, Designs and Patents Act 1988, the author of a computer-generated work is the person who made the arrangements necessary for its creation. The legal position on AI-generated content ownership is evolving. To the extent that copyright subsists in any AI Output and Jobbit is considered the author, Jobbit hereby grants you a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and distribute such AI Output for any lawful purpose, subject to these Terms.
- Platform IP: All intellectual property in the Platform itself, including its software, algorithms, models, designs, branding, and documentation, remains the exclusive property of Jobbit or its licensors.
5.3 Licence to Jobbit
5.3.1 By uploading Content or generating AI Outputs on the Platform, you grant Jobbit a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and process such Content and AI Outputs solely for the purposes of:
- providing and operating the Platform and its features;
- improving the Platform and developing new features; and
- training and improving AI models, but only where you have provided explicit, separate consent under Clause 5.4.
5.4 AI Model Training Consent
5.4.1 We will not use your Content or AI Outputs to train or improve AI models without your explicit opt-in consent. This consent is separate from your acceptance of these Terms and may be granted or withdrawn at any time through your account settings. Where you withdraw consent, we will cease using your data for training purposes within 30 days, although we cannot reverse training that has already occurred.
5.5 AI Transparency
5.5.1 In accordance with emerging UK and EU AI transparency requirements, you acknowledge that:
- all content generated by our AI Tools is produced by artificial intelligence, not by humans;
- AI Outputs may include machine-readable markers or metadata identifying them as AI-generated; and
- if you share AI Outputs publicly, you should disclose that they were generated using AI, particularly where the content depicts real or realistic-looking persons.
6. Biometric Data and Deepfake Policy
6.1 Biometric Data Processing
6.1.1 Certain AI Tools (including Face Swap, Motion Sync, Avatar, Photoshoots, and AI Stylist) process Biometric Data. Under UK GDPR, Biometric Data processed for the purpose of uniquely identifying a person constitutes special category data, which requires an Article 9 condition for processing.
6.1.2 Separate explicit consent: Before using any tool that processes Biometric Data, you will be asked to provide specific, informed, and unambiguous consent to that processing. This consent is separate from your acceptance of these Terms and is collected through a dedicated consent mechanism within the relevant tool. You may withdraw this consent at any time, at which point you will no longer be able to use the relevant tool.
6.2 Biometric Data Handling
6.2.1 Where you provide consent for Biometric Data processing, we will:
- process your Biometric Data solely for the purpose of enabling the relevant AI Tool’s functionality;
- retain Biometric Data for no longer than 30 days following the completion of the relevant processing task, after which it will be automatically and permanently deleted;
- not share your Biometric Data with any third party except where strictly necessary for processing (for example, a sub-processor providing AI model infrastructure), in which case appropriate data processing agreements are in place; and
- implement appropriate technical and organisational measures to protect your Biometric Data against unauthorised access, loss, or destruction.
6.3 Third-Party Likeness
6.3.1 You must not upload photographs, videos, or audio of any other person to any Biometric Data tool without that person’s explicit, informed consent. By uploading content depicting another person, you represent and warrant that you have obtained their freely given consent to the processing of their Biometric Data through the Platform. You shall indemnify Jobbit against any claims, losses, or liabilities arising from your failure to obtain such consent.
6.4 Prohibited Deepfake Uses
6.4.1 You must not use any AI Tool on the Platform to create Deepfakes or AI-manipulated content that:
- depicts any person in a sexual or intimate context without their explicit consent (this is a criminal offence under the Online Safety Act 2023);
- impersonates any person for the purpose of fraud, deception, or misrepresentation;
- is intended to harass, intimidate, bully, or defame any person;
- depicts a minor in any harmful, sexualised, or exploitative context;
- is designed to mislead the public, interfere with democratic processes, or constitute disinformation; or
- violates any applicable law or the rights of any third party.
6.4.2 Violation of this Clause 6.4 will result in immediate account termination and may be reported to law enforcement authorities.
7. AI Agent: Scope, Authority, and Liability
IMPORTANT: This Clause 7 contains important provisions about the AI Agent feature. Please read it carefully. The AI Agent is an autonomous system that takes actions on your behalf, including committing you to financial obligations and arranging services with Freelancers.
7.1 What the AI Agent Does
7.1.1 When you submit a natural-language instruction to the AI Agent, the Agent may:
- analyse your request and design a workflow to fulfil it;
- perform digital tasks autonomously (including web research, planning, scheduling, bookings, data processing, and communications);
- select, engage, and coordinate Freelancers to carry out physical tasks; and
- manage the end-to-end delivery of tasks that require both AI planning and human execution.
7.2 Scope of Authority
7.2.1 By submitting an instruction to the AI Agent, you grant the Agent authority to act on your behalf within the following parameters:
- Spending limits: The AI Agent may commit you to expenditure up to the spending limit set in your account preferences (the “Authorisation Threshold”). Any action that would cause total task expenditure to exceed your Authorisation Threshold will require your explicit approval before proceeding.
- Default threshold: Unless you adjust it, the default Authorisation Threshold is £[50]. You may adjust this at any time through your account settings.
- Approval for significant actions: The Agent will seek your approval before taking any action that involves entering a commitment on your behalf that cannot be cancelled or reversed, engaging a Freelancer for a task exceeding the Authorisation Threshold, or sharing your personal data with a third party beyond what is necessary for task delivery.
7.3 Autonomous Actions and Disclosure
7.3.1 You acknowledge and agree that the AI Agent may take autonomous digital actions without seeking your approval for each step, including searching the internet, comparing service providers, generating itineraries, sending booking confirmations, and communicating task details to Freelancers on your behalf. The Agent will maintain a full activity log accessible through your account dashboard.
7.4 Allocation of Risk and Liability
7.4.1 Responsibility for AI Agent actions is allocated as follows:
- AI misinterpretation: Where the AI Agent materially misinterprets a clear instruction and this results in a booking or expenditure that does not reflect your stated intent, Jobbit will, at its discretion, either reverse the transaction (where possible) or credit your account with the amount expended, up to a maximum of £[500] per incident.
- Ambiguous instructions: Where you provide an instruction that is ambiguous, incomplete, or reasonably capable of multiple interpretations, and the Agent acts on a reasonable interpretation of that instruction, you accept responsibility for the resulting action and any associated costs.
- Freelancer performance: Jobbit is not liable for the quality, timeliness, or outcome of any Services provided by a Freelancer, whether that Freelancer was selected by you directly or by the AI Agent. Clause 8 (Freelancer Marketplace) and Clause 13 (Jobbit Protection) apply.
- Recommendations are not advice: Any suggestions, recommendations, itineraries, or plans generated by the AI Agent are informational only. They do not constitute professional, legal, financial, medical, or any other form of advice. You should exercise your own judgement before acting on any AI Agent recommendation.
7.5 Limitations of the AI Agent
7.5.1 The AI Agent is an evolving technology. You acknowledge that:
- the Agent may not always correctly interpret complex, nuanced, or multi-step instructions;
- the Agent relies on publicly available information and Platform data, which may be incomplete or out of date;
- the Agent cannot guarantee Freelancer availability, pricing, or service quality; and
- Jobbit may modify, restrict, or discontinue the AI Agent feature at any time with reasonable notice.
8. Freelancer Marketplace
8.1 Independent Contractor Status
8.1.1 Freelancers on the Platform are independent contractors. They are not employees, workers, or agents of Jobbit. Jobbit does not control or direct how Freelancers perform their services. Freelancers set their own rates (subject to any Platform minimum or maximum), choose which jobs to accept, provide their own tools and equipment, and determine their own working methods. Nothing in these Terms or in the operation of the Platform creates an employment, partnership, joint venture, or agency relationship between Jobbit and any Freelancer.
8.2 Verification and Vetting
8.2.1 The Platform refers to Freelancers as “verified professionals.” This means that Jobbit has:
- confirmed the Freelancer’s identity through our identity verification process;
- obtained the Freelancer’s self-certification that they hold any qualifications, licences, or insurance required for the services they offer; and
- checked that the Freelancer has accepted the Freelancer Terms of Service.
8.2.2 “Verified” does not mean that Jobbit has independently audited the Freelancer’s qualifications, conducted a criminal background check (unless explicitly stated for a particular service category), or guaranteed the quality of any services. Users should satisfy themselves as to the suitability of any Freelancer before engaging their services.
8.3 Regulated Trades and Professions
8.3.1 Certain service categories on the Platform (including but not limited to plumbing, locksmith services, electrical work, gas work, and fitness coaching) may involve regulated activities requiring specific qualifications, registrations, or insurance. Freelancers in these categories are required under the Freelancer Terms of Service to:
- hold all licences, certifications, and registrations required by law for the services they offer;
- maintain appropriate professional indemnity and/or public liability insurance; and
- comply with all applicable health and safety regulations.
8.3.2 Jobbit does not independently verify ongoing compliance. If you have concerns about a Freelancer’s qualifications or regulatory status, you should request evidence directly from the Freelancer before engaging their services.
8.4 Contractual Relationship
8.4.1 When you engage a Freelancer through the Platform (whether directly or via the AI Agent), the contract for the provision of Services is formed between you and the Freelancer. Jobbit’s role is limited to:
- facilitating the introduction and matching process;
- providing the communications infrastructure;
- processing payments on behalf of the Freelancer; and
- offering the Jobbit Protection scheme described in Clause 13.
8.5 Ratings, Reviews, and Disputes
8.5.1 Users may leave ratings and reviews following the completion of a Service. All reviews must be honest, fair, and based on genuine experience. Jobbit reserves the right to remove reviews that are fraudulent, defamatory, or in breach of these Terms. For disputes between Users and Freelancers, see Clause 14.
9. Payments, Credits, and Referral Programme
9.1 Payment Processing
9.1.1 Subscriptions and Credit packs purchased within the App are sold as in-app purchases and are processed by Apple through the App Store. These purchases are charged to your Apple Account and are subject to Apple’s Media Services Terms and Conditions. Jobbit does not receive or store your payment card details for in-app purchases.
9.1.2 Subscriptions purchased through the App Store renew automatically at the end of each billing period at the price shown at the time of purchase unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple Account settings (Settings > Apple Account > Subscriptions).
9.1.3 Payments made within the App for Freelancer Services and for other non-digital items (for example, domain registrations) are processed by Stripe, Inc. When you make such a payment, you are authorising Stripe, Inc to process the transaction. Jobbit does not store your full payment card details.
9.2 Credits
9.2.1 Credits may be purchased through the Platform at the prices displayed at the time of purchase.
9.2.2 Credits expire 12 months from the date of purchase unless otherwise stated at the time of purchase.
9.2.3 Credits have no monetary value outside the Platform. They are non-transferable and may not be sold, traded, or exchanged for cash.
9.2.4 Where Credits were purchased as an in-app purchase through the App Store, refunds are issued by Apple under Apple’s refund policy and must be requested from Apple; where Apple grants a refund, the corresponding Credits will be removed from your account. For Credits purchased by any other means, unused, unexpired Credits may be refunded upon request, subject to any applicable deductions for Credits already consumed. Refund requests must be made within 14 days of purchase for a full refund (in accordance with the Consumer Contracts Regulations 2013), or within 30 days thereafter for a pro-rata refund.
9.2.5 Credits that have been used for AI Tool processing or applied to Freelancer service fees are non-refundable except where you have a statutory right to a refund under the Consumer Rights Act 2015.
9.3 Freelancer Payments
9.3.1 Payments for Freelancer services are processed through the Platform. Jobbit holds funds on behalf of the User and releases payment to the Freelancer upon confirmed completion of the task, or in accordance with any milestone payment structure agreed between the User and Freelancer. Jobbit charges a service fee of up to 25% on each transaction, deducted from the Freelancer’s payment.
9.4 Referral Programme
9.4.1 Eligible Users may earn bonus Credits by referring new Users to the Platform through the referral mechanism provided.
9.4.2 Referral rewards are non-transferable, have no cash value, and are subject to the same expiry and usage terms as purchased Credits.
9.4.3 You must not distribute referral links in bulk, through spam, or in any way that violates applicable anti-spam legislation.
9.4.4 Jobbit reserves the right to modify, suspend, or terminate the referral programme at any time, with reasonable notice to participants.
9.4.5 Jobbit reserves the right to revoke referral rewards obtained through fraudulent or manipulative means.
10. Consumer Rights
10.1 Statutory Rights
10.1.1 Nothing in these Terms affects your statutory rights as a consumer. Under the Consumer Rights Act 2015, digital content supplied through the Platform (including AI Tool functionality) must be of satisfactory quality, fit for a particular purpose, and as described. If digital content does not meet these standards, you may be entitled to a repair, replacement, or refund.
10.2 Right of Cancellation
10.2.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a distance contract within 14 days of the date of the contract without giving any reason. To exercise this right, you must inform us of your decision to cancel by a clear statement to ‘business@jobbit.uk’. Refunds for purchases made through the App Store are issued by Apple, and we will help you make that request where needed.
10.2.2 If you have requested that the supply of digital content begins before the end of the 14-day cancellation period, you acknowledge that you will lose your right of cancellation once the digital content has been fully supplied.
10.3 Freelancer Services
10.3.1 Cancellation of Freelancer services is governed by the terms agreed between you and the Freelancer at the time of booking. Where the AI Agent has arranged a service on your behalf, the cancellation terms applicable to that service will be made available to you in your task summary before any commitment is confirmed.
11. Data Protection and Privacy
11.1 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003. Our Privacy Policy sets out in full:
- the categories of personal data we collect (including identity, contact, financial, biometric, voice, location, usage, and AI interaction data);
- the lawful bases for each processing activity;
- who we share data with and under what conditions;
- international data transfers and the safeguards in place;
- data retention periods for each category;
- your data subject rights; and
- our Data Protection Impact Assessments for high-risk processing activities.
11.2 Automated Decision-Making
11.2.1 The AI Agent and AI Tools involve automated decision-making. In accordance with the Data (Use and Access) Act 2025 and the UK GDPR, you have the right to:
- be informed about the existence of automated decision-making, including meaningful information about the logic involved;
- request human review of any significant decision made by the AI Agent that affects you; and
- contest any automated decision and express your point of view.
11.3 Cookies
11.3.1 Our Cookie Policy, available with our supplemental policies document, explains how we use cookies and similar technologies. By using the Platform, you consent to our use of cookies in accordance with that policy and the Privacy and Electronic Communications Regulations 2003.
12. Acceptable Use Policy
12.1 The full Acceptable Use Policy is available in our supplemental policies and is incorporated into these Terms by reference. In summary, you must not use the Platform to:
- create non-consensual intimate imagery or Deepfakes (a criminal offence under the Online Safety Act 2023);
- impersonate any person for the purpose of fraud, deception, or identity theft;
- generate, upload, or distribute child sexual abuse material or any content that exploits minors;
- engage in harassment, hate speech, bullying, or discrimination contrary to the Equality Act 2010;
- infringe any third party’s intellectual property rights;
- create misleading content intended to deceive the public or constitute disinformation;
- upload malware, attempt unauthorised access to any system, or interfere with the Platform’s operation, contrary to the Computer Misuse Act 1990;
- use Freelancer services for any illegal purpose;
- use the AI Agent to attempt social engineering, fraud, or any form of manipulation; or
- circumvent any content moderation, safety filter, or usage restriction on the Platform.
12.2 Enforcement: Violations will result in a graduated response: (i) warning and content removal; (ii) temporary account suspension; (iii) permanent account termination; and (iv) reporting to law enforcement where the violation constitutes or may constitute a criminal offence.
13. Jobbit Protection
13.1 Jobbit Protection is a discretionary scheme designed to help resolve issues that may arise during Services arranged through the Platform. It is not an insurance policy and does not create any legal obligation on Jobbit to pay compensation.
13.2 Eligibility
13.2.1 To be eligible for Jobbit Protection, you must:
- have an account in good standing with no outstanding breaches of these Terms;
- have first attempted in good faith to resolve the issue directly with the Freelancer;
- submit your claim within 14 days of the Service giving rise to the complaint; and
- provide reasonable evidence of the loss or damage claimed.
13.3 Scope
13.3.1 Jobbit may, in its sole discretion, offer compensation of up to £100 per incident for direct property damage or personal injury arising from the performance of a Service booked through the Platform.
13.4 Exclusions
13.4.1 Jobbit Protection does not cover: loss of earnings or profits; damage to common areas; pre-existing damage; any loss arising from the User’s own instructions, negligence, or breach of these Terms; or any loss that is covered by the User’s or Freelancer’s own insurance.
13.5 Resolution
13.5.1 If a claim is approved, the User must execute a Jobbit Resolutions Agreement, release Jobbit from further liability in relation to the claim, and refund any amounts subsequently determined to have been erroneously paid.
14. Dispute Resolution
14.1 Internal Complaints
14.1.1 If you have a complaint about the Platform or any Service, you should first contact us at ‘business@jobbit.uk’. We will acknowledge your complaint within 5 working days and aim to provide a substantive response within 15 working days.
14.2 User-Freelancer Disputes
14.2.1 Disputes between Users and Freelancers should first be resolved directly between the parties. If direct resolution fails, either party may request that Jobbit facilitate mediation through the Platform. Jobbit’s role in mediation is limited to facilitating communication; Jobbit is not an arbitrator and will not impose a resolution.
14.3 Online Dispute Resolution
14.3.1 In accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we inform you that the European Commission’s Online Dispute Resolution platform is available at https://ec.europa.eu/odr. We are not currently obliged to participate in ADR proceedings before a consumer arbitration body, but we will consider doing so on a case-by-case basis.
14.4 Governing Law and Jurisdiction
14.4.1 These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, provided that nothing in this clause limits your rights as a consumer to bring proceedings in the courts of the country in which you are domiciled.
15. Limitation of Liability
IMPORTANT: This Clause 15 sets out the entire financial liability of Jobbit to you. Please read it carefully.
15.1 Unlimited Liability
15.1.1 Nothing in these Terms excludes or limits Jobbit’s liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited by law.
15.2 Exclusions
15.2.1 Subject to Clause 15.1, Jobbit shall not be liable to you for:
- any indirect, consequential, special, or incidental loss or damage;
- any loss of profit, revenue, business, anticipated savings, data, or goodwill;
- any loss or damage arising from the acts, omissions, conduct, or quality of services of any Freelancer;
- any loss or damage arising from your reliance on any AI Output, AI Agent recommendation, or automated decision; or
- any loss arising from circumstances beyond our reasonable control (see Clause 18).
15.3 Liability Cap
15.3.1 Subject to Clauses 15.1 and 15.2, Jobbit’s total aggregate liability to you in respect of all claims arising out of or in connection with these Terms shall not exceed the greater of:
- the total amount paid by you to Jobbit in the 12 months immediately preceding the event giving rise to the claim; or
- £500.
15.4 Fairness
15.4.1 The limitations and exclusions in this Clause 15 are considered fair and reasonable having regard to the nature of the Platform, the fact that Jobbit acts as an intermediary and not a provider of services, and the availability of Jobbit Protection under Clause 13.
16. Indemnification
16.1 User Indemnity
16.1.1 You agree to indemnify, defend, and hold harmless Jobbit (Josephine Willis) and any staff, contractors, and agents engaged by Jobbit from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:
- your breach of these Terms or any applicable law;
- your use of the AI Tools in a manner that infringes a third party’s rights;
- Content you upload to the Platform that is defamatory, infringing, or otherwise unlawful;
- your uploading of a third party’s Biometric Data without their consent; or
- any fraudulent, negligent, or intentionally harmful act or omission by you.
16.2 Proportionality
16.2.1 This indemnity is without prejudice to your statutory rights as a consumer. The indemnity obligations in this clause shall not apply to the extent that the relevant claim arises from Jobbit’s own negligence, wilful misconduct, or breach of these Terms.
17. Termination and Suspension
17.1 Termination by You
17.1.1 You may close your account at any time through your account settings or by contacting us at ‘business@jobbit.uk’. Upon closure:
- any unused, unexpired Credits will be refunded in accordance with Clause 9.2;
- you may request an export of your personal data in a portable format (in accordance with your UK GDPR right to data portability);
- any in-progress tasks arranged through the AI Agent will be completed or cancelled, at your election; and
- your Content and AI Outputs will be retained for 30 days to allow retrieval, after which they will be permanently deleted (subject to any legal obligation to retain data for longer).
17.2 Termination or Suspension by Jobbit
17.2.1 We may suspend or terminate your account:
- immediately and without notice in cases of serious breach, including violation of Clause 6.4, Clause 12, or suspected fraud;
- with 14 days’ notice for lesser breaches that are not remedied within that notice period; or
- with 30 days’ notice where we are discontinuing part or all of the Platform.
17.3 Effect of Termination
17.3.1 Upon termination for any reason:
- all licences granted to you under these Terms cease immediately;
- Clauses that by their nature should survive termination (including Clauses 5.2, 6, 13, 14, 15, 16, 20, and 21) shall continue in full force and effect; and
- Biometric Data will be deleted within 30 days of termination in accordance with Clause 6.2.
18. Force Majeure
18.1 Jobbit shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, civil unrest, government actions, power failures, internet or telecommunications failures, cyber-attacks, or failures of third-party service providers.
18.2 We will use reasonable efforts to mitigate the impact of any force majeure event and will resume performance as soon as reasonably practicable.
19. General Provisions
19.1 Entire Agreement
19.1.1 These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any supplemental terms applicable to specific features, constitute the entire agreement between you and Jobbit in relation to your use of the Platform and supersede all previous agreements, representations, and arrangements.
19.2 Severability
19.2.1 If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If it cannot be so modified, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.
19.3 Waiver
19.3.1 No failure or delay by Jobbit in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy preclude any other or further exercise of that or any other right or remedy.
19.4 Assignment
19.4.1 You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Jobbit may assign or transfer its rights and obligations under these Terms to any successor operator of the Platform, including on the incorporation of the business or a sale of all or substantially all of its assets, provided that such assignment does not materially reduce your rights under these Terms.
19.5 Third-Party Rights
19.5.1 Except as set out in Clause 21 (Apple App Store Terms), these Terms do not confer any rights on any person other than the parties to these Terms, and no third party shall have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms.
19.6 Notices
19.6.1 All notices to Jobbit must be sent by email to ‘business@jobbit.uk’ or by post to our business address set out in Clause 2.1. 19.7.1 By using the Platform and accepting these Terms, you agree that your electronic acceptance constitutes your legal signature and has the same effect as a handwritten signature.
20. AI Regulatory Compliance
20.1 Jobbit is committed to responsible AI development and deployment. In anticipation of the UK AI Bill and in recognition of the extraterritorial scope of the EU AI Act (Regulation 2024/1689):
- Transparency: We clearly identify all AI-generated content and ensure that AI Outputs carry machine-readable markers where technically feasible, in accordance with Article 50 of the EU AI Act.
- Deepfake disclosure: Users who share AI-generated or AI-manipulated content depicting persons must disclose that the content is artificial, in accordance with Article 50(4) of the EU AI Act.
- Safety and fairness: We adhere to the UK government’s five core AI principles: safety, security, and robustness; appropriate transparency and explainability; fairness; accountability and governance; and contestability and redress.
- Human oversight: The AI Agent operates under the spending limits and approval workflows described in Clause 7.2, ensuring meaningful human oversight of significant autonomous actions.
- Ongoing compliance: We will update these Terms and our practices to reflect new regulatory requirements as the UK AI Bill and EU AI Act implementation progresses.
21. Apple App Store Terms
21.1 The App is distributed through the Apple App Store. The following terms apply because of that distribution and, in the event of any conflict, prevail over the rest of these Terms in relation to Apple:
- Acknowledgement: These Terms are concluded between you and Jobbit only, and not with Apple. Jobbit, not Apple, is solely responsible for the App and its content. Where these Terms provide for usage rules that are less restrictive than, or otherwise conflict with, the Apple Media Services Terms and Conditions, the Apple terms take precedence.
- Scope of licence: Jobbit grants you a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support: Jobbit is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- Warranty: Jobbit is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Jobbit’s sole responsibility.
- Product claims: Jobbit, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property: In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party’s intellectual property rights, Jobbit, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country; and (ii) you are not listed on any United States Government list of prohibited or restricted parties.
- Developer contact: Questions, complaints, or claims about the App should be directed to Josephine Willis, trading as Jobbit, Flat 5, 26 Sussex Street, Brighton, BN2 9QW, United Kingdom, or by email to ‘business@jobbit.uk’.
- Third-party terms: You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
- Third-party beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
